Welcome to Likhaan. Throughout the site, the terms "we," "us," and "our" refer to Likhaan Technology Inc. Likhaan operates a mobile-responsive web platform for Filipino creators and their creations, including marketplace, social commerce, custom order, learning, events, messaging, and related support features.

By accessing, browsing, creating an account, purchasing, posting, commenting, saving, following, submitting content, applying as a Creator, submitting an event, using Likhaan Space, using Likhaan Learn, or otherwise using the Platform, you agree to these Terms of Use and all related policies, including the Creator Policy (for creators), Privacy Policy, Shipping Policy and Refunds Policy, and any rules shown during checkout, registration, submission, or use.

If you do not agree, you must not use the Platform.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to this page or our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and Services to you.

 

A. ELIGIBILITY AND ACCOUNT USE

A.1 Age requirement

You represent that you are at least 18 years old, or that you are using the Platform with the supervision and consent of a parent or legal guardian where legally allowed.

A.2 Account information

You agree to provide truthful, accurate, complete, and updated account, billing, shipping, contact, profile, and transaction information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account.

A.3 Account roles

The Platform may support different roles, including Guest, Buyer, Creator Applicant, Approved Creator, and Admin. Guests may browse but may not access certain features, including checkout, messaging, saving, posting, or custom order functions. Registered Buyers may purchase, save, follow, message, submit requests, access Learn, and interact with available social features. Creator Applicants do not receive seller tools until approved. Approved Creators receive access to Creator tools, subject to the Creator Policy.

 

B. PLATFORM SERVICES

B.1 Services covered

Likhaan's services may include:

• Marketplace browsing and purchasing.

• Creator profiles and storefronts.

• Product listings and order tools.

• Likhaan Space for custom requests, quotes, commissions, bulk orders, and collaborations.

• Social features such as feeds, posts, comments, likes, saves, follows, tags, and collections.

• Likhaan Learn modules, guides, videos, quizzes, and progress tracking.

• Events and opportunity listings.

• Messaging and customer support.

• Rewards, affiliate, marketing, analytics, and other features where available.

B.2 Shopify and third-party tools

The Platform is hosted on Shopify and may rely on third-party processors, payment gateways, logistics providers, analytics tools, email tools, video hosting services, moderation tools, and other service providers. Your use of certain features may also be subject to third-party terms.

B.3 Changes to services

Likhaan may modify, suspend, discontinue, test, limit, or replace any part of the Platform at any time, including features, designs, prices, categories, content, availability, tools, policies, and user permissions.

 

C. MARKETPLACE ROLE

C.1 Marketplace operator and intermediary

Likhaan operates as a marketplace operator, social commerce platform, and intermediary. Products may be listed and sold by independent Creators. Unless Likhaan is expressly identified as the seller of record for a specific transaction, the sale is between the Buyer and the Creator identified in the Listing.

C.2 No automatic ownership or inventory control

Unless otherwise stated, Likhaan does not own Creator inventory and does not take title to Creator products. Likhaan may temporarily handle products for shipping, returns, events, exhibitions, documentation, failed delivery, or operational purposes without taking ownership.

C.3 Creator information and Listings

Creators are responsible for the accuracy of their Listings, product descriptions, stock, prices, images, materials, dimensions, lead times, warranties, cultural information, and compliance with applicable law. Likhaan may review, moderate, edit, hide, or unpublish Listings but does not guarantee that every Listing is error-free.

C.4 Platform-level dispute role

Likhaan may assist with customer service and dispute resolution. Likhaan may make platform-level decisions on refunds, replacements, exchanges, cancellations, payout holds, Listing removals, account restrictions, and other remedies under its posted policies.

 

D. BUYER TERMS

D.1 Purchases

When you place an Order, you agree to pay the Listing Price, shipping fee, taxes, duties, customs fees, payment fees, or other charges shown at checkout or separately confirmed before dispatch.

D.2 No guest checkout

Account creation may be required to complete purchases, use messaging, submit custom requests, save items, access certain features, or receive order updates.

D.3 Order review

Likhaan may cancel, pause, review, or require confirmation for Orders that appear fraudulent, mispriced, unavailable, high-risk, out of stock, non-compliant, suspicious, or otherwise unsuitable for fulfillment.

D.4 Address and contact accuracy

You are responsible for providing a complete and accurate delivery address, phone number, email address, and receiving instructions. Failed delivery due to inaccurate information, non-response, refusal, unavailability, customs refusal, or failure to pay required duties may affect your refund eligibility.

D.5 Delivery Confirmation and Issue Reporting

Once an order is marked as delivered, the Buyer may be asked to confirm receipt or report any issue within the applicable confirmation window. If the Buyer confirms receipt, or if no issue is reported within the confirmation window, the order may be marked as completed and the Creator’s payout may become eligible for release, subject to Likhaan’s policies and review.

Buyers must report damaged, missing, incorrect, or materially misrepresented items within the timelines stated in the Shipping and Refunds Policy.

 

E. CANCELLATIONS, RETURNS, REFUNDS, AND EXCHANGES

Orders, cancellations, returns, refunds, exchanges, missing items, damaged items, lost items, failed deliveries, customs issues, and replacements are governed by the Shipping Policy and Refunds Policy.

As a general rule, change of mind, buyer's remorse, preference changes, and accurately disclosed handmade variations are not valid grounds for return or refund.

F. LIKHAAN SPACE TERMS

F.1 Custom requests and quotes

Likhaan Space allows registered users to post custom requests, commission briefs, bulk order requests, collaboration inquiries, and similar opportunities. Creators may respond with quotes, timelines, clarifications, sample work, and proposed terms.

F.2 Accepted quote and payment

Once a Buyer accepts a quote and payment is made, the accepted quote, scope, timeline, specifications, and reference materials become the working terms for the custom order. Neither the Buyer nor the Creator may unilaterally cancel the project after payment without Likhaan admin review and approval.

F.3 Payment holdback

Likhaan may collect full payment from the Buyer and release payment to the Creator in stages. Unless otherwise stated, Likhaan may release 50 percent of the Creator's net payout after project acceptance or production start, and hold the remaining 50 percent until delivery is confirmed, the buyer inspection window has passed, or Likhaan determines that the order has been completed without unresolved issues.

F.4 Scope changes

Any material change in size, quantity, design, materials, deadline, delivery address, revision request, cultural requirement, or other agreed term may require a new quote, extra payment, timeline adjustment, or admin approval.

F.5 Cultural and restricted requests

Users must not request sacred, restricted, culturally sensitive, unauthorized, infringing, illegal, harmful, or misleading designs. Likhaan may reject, pause, edit, or remove requests that may violate intellectual property, cultural boundaries, safety standards, law, or Platform policies.

 

G. SOCIAL FEATURES, USER CONTENT, AND COMMUNITY RULES

G.1 User content

Users may be allowed to submit, upload, post, comment, review, save, tag, collect, message, or otherwise contribute content. You are responsible for your content and must ensure that it is accurate, lawful, respectful, and that you have the right to submit it.

G.2 Limited permission to Likhaan

By submitting content, you grant Likhaan a limited, non-exclusive, royalty-free, worldwide permission to host, display, reproduce, resize, format, publish, distribute, moderate, promote, archive, and share the content as reasonably necessary to operate the Platform, provide services, promote the Platform, support transactions, maintain records, and comply with law.

This does not transfer ownership of your content to Likhaan. Creator content is also governed by the Creator Policy.

G.3 Community conduct

You must not post, submit, message, or share content that is illegal, infringing, fraudulent, abusive, hateful, harassing, discriminatory, obscene, misleading, spammy, malicious, culturally exploitative, unsafe, or harmful to Likhaan, creators, buyers, partners, or the public.

G.4 Moderation

Likhaan may review, edit, hide, remove, restrict, report, preserve, or refuse any content, Account, Listing, event submission, review, comment, collection, message, or request at its discretion.

 

H. MESSAGING, SAFETY, AND NO CIRCUMVENTION

Users may be allowed to communicate through Platform messaging or related channels. Likhaan may filter, block, scan, review, or moderate communications for safety, fraud prevention, privacy, support, off-platform dealing, and policy compliance.

Users must not use Likhaan to discover another user and then move the same or related transaction outside the Platform to avoid fees, payment protection, shipping procedures, cultural safeguards, or Platform rules.

Phone numbers, email addresses, external payment links, web addresses, QR codes, or other off-platform contact attempts may be blocked, flagged, or reviewed.

I. LIKHAAN LEARN

Likhaan Learn content is provided for general educational and capacity-building purposes. It may cover topics such as BIR registration, IPOPHL awareness, pricing, packaging, marketing, storytelling, platform use, creator readiness, and business growth.

Likhaan Learn is not legal, tax, accounting, financial, investment, or professional advice. Users should consult qualified professionals for legal, tax, accounting, regulatory, or business decisions.

Unless otherwise stated, Likhaan Learn videos, scripts, modules, templates, worksheets, quizzes, graphics, and materials are owned by Likhaan or the credited content owner. Users may not copy, redistribute, resell, upload, scrape, or commercially reuse Learn content without written permission.

 

J. EVENTS AND SUBMISSIONS

Users may submit events, opportunities, workshops, exhibits, fairs, deadlines, or related information for Likhaan's review. Submission does not guarantee publication, promotion, endorsement, attendance, or partnership.

Likhaan may approve, reject, edit, categorize, feature, unpublish, or remove event submissions at its discretion. Event organizers are responsible for their own event accuracy, safety, permissions, ticketing, registration, refunds, taxes, venue rules, and personal data practices.

Publication of an event on Likhaan does not automatically mean Likhaan endorses, sponsors, guarantees, or organizes the event unless expressly stated.

 

K. INTELLECTUAL PROPERTY

K.1 Likhaan property

Likhaan owns or controls the Likhaan name, logo, trademarks, service marks, brand assets, website design, Platform layout, user interface, workflows, original content, databases, compilations, and other Platform materials, except Creator content or third-party content used with permission.

You may not copy, reproduce, scrape, modify, distribute, resell, exploit, impersonate, or use Likhaan intellectual property without written permission.

K.2 Creator and user property

Creators and users retain ownership of their own content, subject to the limited permissions granted to Likhaan under these Terms, the Creator Policy, or separate written agreements.

K.3 IP complaints

If you believe content on Likhaan infringes your rights, contact info@likhaan.com with the relevant details. Likhaan may remove or restrict content, request information, notify users, and suspend repeat violators where appropriate.

 

L. PRIVACY

Likhaan processes personal data in accordance with the Privacy Policy,. By using the Platform, you acknowledge that Likhaan may collect, use, share, retain, and protect personal data as described in the Privacy Policy, including data needed for accounts, orders, shipping, creator onboarding, payout processing, messaging, learning progress, events, analytics, fraud prevention, compliance, and support.

 

M. PROHIBITED USES

You must not use the Platform for illegal, fraudulent, abusive, unsafe, infringing, deceptive, discriminatory, exploitative, spam, malicious, or unauthorized purposes. You must not interfere with Platform security, upload harmful code, scrape data without permission, impersonate others, manipulate reviews, submit false claims, abuse promotions, or violate laws or rights of others.

 

N. DISCLAIMERS

The Platform, services, content, tools, and features are provided on an "as is" and "as available" basis to the fullest extent allowed by law.

Likhaan does not guarantee uninterrupted access, error-free operation, exact color display, guaranteed sales, guaranteed visibility, guaranteed creator performance, guaranteed buyer payment behavior outside Platform rules, guaranteed courier performance, or guaranteed legal or tax outcomes.

 

O. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Likhaan shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost opportunities, lost data, reputational harm, business interruption, or similar damages arising from your use of or inability to use the Platform.

This does not limit rights or remedies that cannot be waived under applicable law.

 

P. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Likhaan, its officers, directors, employees, contractors, agents, partners, service providers, affiliates, and representatives from claims, losses, damages, liabilities, costs, and expenses arising from your breach of these Terms, misuse of the Platform, violation of law, infringement of rights, false information, fraud, misconduct, or content you submit.

Q. TERMINATION

Likhaan may suspend, restrict, remove, or terminate access to the Platform, Account, features, content, Orders, Listings, messages, events, or services if you violate these Terms or any related policy, create legal or operational risk, harm other users, fail verification, misuse the Platform, or threaten marketplace integrity.

Obligations incurred before termination survive termination, including payment obligations, pending Orders, returns, refunds, disputes, confidentiality, data protection, indemnity, and intellectual property provisions.

R. GOVERNING LAW

These Terms are governed by the laws of the Republic of the Philippines, subject to mandatory legal rules.

 

S. CHANGES TO THESE TERMS

Likhaan may update these Terms from time to time by posting the updated version on the Platform or giving notice where appropriate. Your continued use of the Platform after updates are posted constitutes acceptance of the updated Terms, subject to applicable law.
